1031 exchange in Southern Highlands: more rental for the same money

Don't want to pay taxes? Do a 1031 exchange. Let me show you how. Sell the rental, buy the next property inside the deadlines, and defer the capital gains tax instead of writing the check this year.

1031 exchange in Southern Highlands: where the equity stretches

Southern Highlands shows up in a 1031 exchange more often as the replacement than as the property being sold. The reason is simple. A master-planned community south of the Strip off the 15 usually gets a buyer more house for the money than a comparable Summerlin address, with the airport closer, and that is a useful thing when you have a fixed amount of exchange proceeds and 180 days to place them. An owner selling a Summerlin or Henderson rental can often buy a newer, larger rental here and still meet the equal-or-greater-value rule.

It also works in the other direction. If you own a Southern Highlands rental, bought as a first home and kept when you moved up, the gain after years of ownership can be large enough that selling and paying the tax this year hurts. An exchange defers it, provided the sale and the purchase are planned together. This is a master-planned community with an association, so the leasing rules in the CC&Rs get read before anything is listed or identified.

Why run it with me

I am John Arendt, a Realtor with Compass Realty & Management, and I have sold homes across the Las Vegas valley for 20 years, Southern Highlands among them. I am not a CPA. Your tax advisor decides whether the exchange makes sense for your return, and I want them involved before the rental is listed. I run the real estate side: the number, the replacement market, the exchange language in both contracts, a qualified intermediary set up before closing, and a calendar you can see.

You get the number first. What the rental is actually worth today, with the recent Southern Highlands sales behind it, and a plain answer on whether the gain is big enough to make the intermediary's fee and the coordination worthwhile. On a house bought recently, the answer may be no, and you hear that from me. The rules, deadlines and exceptions are on the main exchange page.

The exchange, step by step, from or into Southern Highlands

If you are selling here, we start by working out what the replacement should do: another rental with a wider tenant pool, two smaller rentals elsewhere, or a property with less to take care of. If you are buying here with proceeds from a rental elsewhere, we start by knowing the Southern Highlands market before your sale closes, so the identification list is written from real candidates, not a search that begins on day one of 45.

The rental being sold gets the full launch: marketing starts day one, with photography, the Matterport walkthrough and paid advertising running within the first 7 days. The accepted offer carries the exchange language, and the proceeds go from closing to the intermediary. From that day, 45 calendar days to identify up to three candidates in writing and 180 calendar days to close.

Southern Highlands has a couple of things to check before identifying a house here. The association's leasing rules, first. The dues, which belong in the rent math. And the age of the roof and air conditioner, since a rental you will hold for years should not need a contractor in year one. The Friday or Saturday status call that I do on every sale keeps the calendar in front of you.

Southern Highlands compared with where else the proceeds could go

Against Summerlin, you trade Red Rock proximity and Downtown Summerlin for more square footage at the same price, and a shorter airport run for a tenant who travels. Against Henderson, you get a single newer master-planned community rather than a range of ages and lot sizes. Against the city, you get HOA structure where the older neighborhoods offer none. None of those is right for everyone, which is why the replacement conversation happens before the rental is listed.

If you own a rental here or want to buy one here with exchange proceeds, send me the address or call or text 702-881-6562. You get the real number and a straight answer on whether the exchange is worth doing. More about Southern Highlands is here.

Frequently Asked Questions

Why do exchange buyers look at Southern Highlands?

Because the same proceeds usually buy more house here than in Summerlin, which makes the equal-or-greater-value rule easier to meet with a property that also rents well. The airport being closer matters to some tenants too.

Do I have to buy something more expensive than what I sold?

To defer the whole gain you generally buy property of equal or greater value and replace the mortgage you paid off. Buying cheaper or taking cash out is allowed, but the difference is taxed. Your CPA runs those numbers before we identify anything.

Can I identify a Southern Highlands house and two others?

Yes, and I recommend it. You may name up to three candidates regardless of value, and naming more than one protects the exchange if a purchase falls apart late in the 45 days.
