1031 exchange in Anthem: single-story rentals and the age rules

Don't want to pay taxes? Do a 1031 exchange. Let me show you how. Sell the rental, buy the next property inside the deadlines, and defer the capital gains tax instead of writing the check this year.

1031 exchange in Anthem: which Anthem the rental is in

A 1031 exchange in Anthem turns on one question before the tax questions: is the rental in Sun City Anthem or Solera at Anthem, the 55-plus communities, or in the non-restricted neighborhoods? An age-restricted rental has a limited tenant pool and a limited buyer pool, because the occupancy rules apply to whoever lives there, tenant or owner. A non-restricted single-story in Anthem has the widest pool in the valley, downsizers and families both, and it sells and rents to a different market entirely.

That distinction drives the exchange in both directions. Owners of age-restricted rentals sometimes exchange out of them to escape the smaller pool and the clubhouse dues, and into a non-restricted rental with more demand. Owners elsewhere sometimes exchange into an Anthem single-story because it is the kind of house they may want to live in one day, under conversion rules their CPA has to lay out first. Either way, the sale and the purchase are planned together, before the rental is listed, inside deadlines that do not move.

Why an Anthem landlord runs it with me

I am John Arendt, a Realtor with Compass Realty & Management, and I have sold homes across the Las Vegas valley for 20 years, in Anthem and the rest of Henderson among them. I am not a tax advisor, and I say so before anything else. Yours decides whether an exchange fits your return. I run the real estate side: the number on the rental, the replacement market, exchange language in the listing and the offer, a qualified intermediary set up before closing, and every date on a calendar you can see.

The number comes first, and in Anthem it comes from the right comparables. What the rental is actually worth depends on recent sales of the same kind of home in the same community, not an average across the age-restricted and non-restricted neighborhoods. You also get a plain answer on whether the gain justifies the intermediary's fee. How an exchange works, rule by rule, is on the main page.

Running the exchange on an Anthem rental

Before listing, we settle what the replacement should do, and in Anthem that includes a clear look at the tenant pool. Age-restricted communities rent to a narrower group, because the occupancy rules apply to tenants. Non-restricted single-stories rent widely. Newer two-story family plans rent to a different tenant again. We look at the replacement market first, so the 45 days after your closing confirm a plan instead of starting one.

The rental sells with the full launch: marketing starts day one, with photography, the Matterport walkthrough and paid advertising running within the first 7 days. For an age-restricted rental, the listing states the community's occupancy rules plainly, since every buyer and every future tenant has to qualify under them. The accepted offer carries the exchange language, and the proceeds go from closing to the intermediary.

From closing, 45 calendar days to identify up to three candidates in writing and 180 calendar days to close. On any Anthem replacement, read the association documents for leasing rules and dues before you identify it, and if it is age-restricted, understand that the rules govern your tenants. The status call every Friday or Saturday that I do on every sale keeps the calendar in front of you.

Anthem against the nearby choices for a replacement

Anthem's draw for an exchange buyer is the single-story stock, the largest concentration in the valley, and the chance to own a rental that might one day be the house you retire into, if the conversion rules are planned for. The rest of Henderson offers a far wider range of ages, lots and prices to choose from on a clock. Boulder City, half an hour further out, has inventory too thin to count on inside 45 days. Southern Highlands often buys more house for the same money without the age rules.

If you own a rental in Anthem, in either kind of community, send me the address or call or text 702-881-6562. Tell me which community it is in and roughly what you paid, and you get the real number and a straight answer on whether an exchange beats paying the tax. More about Anthem is here.

Frequently Asked Questions

Can I rent out a house in Sun City Anthem or Solera?

Generally yes, subject to the association's leasing rules, and the tenants have to meet the community's age and occupancy requirements just as an owner would. That narrows the tenant pool, which is part of why some owners exchange out of age-restricted rentals.

Can I exchange into an Anthem single-story and move into it later?

It can be done. The property has to be held as a rental first, for a period your CPA will define, and there are rules about how long you own it before selling under the residence exclusion. Plan it from the start, not afterward.

Does the HOA change what my Anthem rental is worth?

Yes. Dues sit in every buyer's monthly number and every tenant's rent math, and in the 55-plus communities the dues fund the clubhouses and pools. The right comparables are recent sales inside the same community, and those are what I use.

Anthem

What 1031 exchange looks like in Anthem

Anthem is single-story living, and it is a real answer for anyone downsizing.

Anthem, in south Henderson, holds the valley's largest concentration of single-story homes, split between the 55-plus communities of Sun City Anthem and Solera at Anthem and the non-restricted neighborhoods where single-story homes mix with two-story family plans.

The homes
Anthem has the largest concentration of single-story homes in the valley, split between age-restricted and not. Sun City Anthem and Solera at Anthem are the 55-and-up communities, built almost entirely on one level with clubhouses, pools and activity calendars. The rest of Anthem mixes single-story homes with two-story family plans.
Why people choose it
Downsizers who want one level, less yard, and a payment and HOA that do not need thinking about, and move-up families buying into a newer Henderson master-planned community.
Getting around
South Henderson, off the 215, a reasonable drive to the airport and the valley's hospitals.
Nearby
Henderson's medical corridor, the airport, and Boulder City about half an hour out.
The trade-off
Age-restricted communities trade quiet streets and amenities for occupancy rules (grandkids can visit but generally cannot live there), a smaller resale pool, and higher dues. The non-restricted single-story homes are the answer if you want kids on bikes on your street.
