1031 exchange in Summerlin: a large gain, read the HOA first

Don't want to pay taxes? Do a 1031 exchange. Let me show you how. Sell the rental, buy the next property inside the deadlines, and defer the capital gains tax instead of writing the check this year.

1031 exchange in Summerlin: why the gain is usually the reason

A 1031 exchange in Summerlin is often driven by the size of the gain. Summerlin rentals tend to have appreciated more than they have cashed out, so an owner who bought years ago and rented the house to a west-side or work-from-home tenant can be sitting on a tax bill that is hard to look at. That is exactly the situation an exchange is built for: sell, roll the gain into the next property, and defer the tax rather than pay it this year.

Summerlin also has a rule you have to respect before anything else. Its villages are master-planned and governed by associations, and some of them limit rentals or set minimum lease terms. That cuts both ways. It can change who will buy your rental and what they will pay, and it means any Summerlin replacement has to be checked against the CC&Rs before it goes on your identification list. Finding a leasing restriction on day 44 of 45 is how exchanges fail.

Working the Summerlin exchange with me

I am John Arendt, a Realtor with Compass Realty & Management, and I have sold homes across the Las Vegas valley for 20 years, Summerlin among them. I am not a tax advisor, and I want yours in the room before the rental is listed. What I run is the real estate side: the number on the rental, the replacement market, exchange language in the listing agreement and the offer, a qualified intermediary set up before closing, and every deadline on a calendar you can see.

The number first. What the Summerlin rental is actually worth, the recent sales in the same village behind it, and a plain answer on whether the gain justifies the intermediary's fee and the coordination. In Summerlin that answer is usually yes, and I still check. The rules of an exchange, rule by rule, live on the main page, so this one stays about Summerlin.

How the exchange runs from a Summerlin rental

The planning starts with the replacement, because the sale price of a Summerlin rental often buys more than one property elsewhere in the valley. Some owners exchange into two rentals in Henderson or the city. Some exchange into a newer Summerlin house with a wider tenant pool. Some move the equity to a small commercial building or land. We look at those markets before the rental is listed so the 45 days are confirmation, not discovery.

The rental sells with the full launch: marketing starts day one, with photography, the Matterport walkthrough and paid advertising running within the first 7 days. Summerlin buyers compare villages closely, so the listing names the village, the dues and the trail and school facts plainly. The accepted offer carries the exchange language, and the proceeds go from closing to the intermediary, never to you.

From closing, 45 calendar days to identify up to three candidates in writing and 180 calendar days to close. Because Summerlin replacements need an HOA check and Summerlin prices leave less room for error, I would rather you identify a Summerlin house and two elsewhere than three in one village. The Friday or Saturday status call that I do on every sale covers the calendar until the last one closes.

Summerlin against the rest of the valley for the replacement

Buying back into Summerlin gives you newer construction, strong tenant demand from the west side and the northwest, and the highest price per square foot in this comparison. Southern Highlands often gets you more house for the same money on the other end of the 215, with the airport closer. Henderson gives you the widest range of ages and prices to choose from on a clock. The city offers no-HOA older neighborhoods if the leasing rules are what you want to leave behind.

Whatever you would want to own next, the first step is the number on what you own now. Send me the address or call or text 702-881-6562, tell me roughly what you paid and whether you want to keep being a landlord, and you get a straight answer on whether an exchange is worth it. Frequently Asked Questions

Can I exchange one Summerlin rental into two properties elsewhere?

Yes. You can identify up to three replacement properties, or more under a value rule your intermediary explains, and close on more than one, as long as the total value and debt meet the rules and everything closes inside 180 days. Selling one higher-priced rental for two is a common Summerlin exchange.

Do Summerlin HOAs restrict rentals?

Some do, through rental caps or minimum lease terms, and the rules differ by association. Read the CC&Rs on your own rental before listing, because it affects who can buy it, and on any Summerlin replacement before you identify it.

My Summerlin rental barely breaks even. Is an exchange still worth it?

Often yes, because the exchange is about the gain, not the cash flow. A house that appreciated a lot while renting for little is exactly the one where deferring the tax matters most. Whether to exchange into something that cashes flows better is the planning conversation.
